- By using Quire and Quill, you represent that you are legally allowed to access public domain and classic literature in your jurisdiction.
2. Account Responsibilities
If you create an account:
- You are responsible for maintaining the confidentiality of your password and login credentials.
- You are responsible for all activity that occurs under your account.
- You agree to notify us immediately of any unauthorized use of your account.
3. Rules of Use (Prohibited Conduct)
You agree not to:
- Post hate speech, abusive language, or discriminatory reviews against any person or group based on race, religion, ethnicity, gender, sexual orientation, or disability.
- Scrape, crawl, or extract data from Quire and Quill using automated tools (bots, scrapers, crawlers) without our written permission.
- Upload, transmit, or distribute malware, viruses, or other harmful code.
- Impersonate another person or entity.
- Use the Platform for any illegal purpose or in violation of any applicable laws.
4. Intellectual Property Rights
A. Our Content (Quire and Quill Owned)
- The Quire and Quill logo, blog posts, original stories, original commentary, and any original creative works produced by us are the exclusive property of Quire and Quill.
- You may not copy, reproduce, distribute, sell, resell, or use our original content for any commercial purpose without our express written permission. Unauthorized distribution or use may result in legal action and liability for damages.
B. Public Domain Books
- The classic books on our platform are verified by us as generally accepted as public domain in the United States. However, copyright laws differ by country.
- It is your responsibility to verify that a book is in the public domain in your country before accessing or downloading it. If you believe a book is not in the public domain in your jurisdiction, do not access it. Instead, contact us contact@quireandquill.com
- If we determine a book is not in the public domain in your country, we will restrict access for users in that jurisdiction.
C. User Content (Reviews, Comments, etc.)
- You retain ownership of any reviews, comments, or other content you post on the Platform.
- By posting, you grant Quire and Quill a non-exclusive, royalty-free, worldwide license to display, store, and share that content on our Platform.
- You may not post content that infringes anyone else’s copyright, trademark, or other intellectual property rights.
5. Public Domain Dispute Process
If you believe a book on Quire and Quill is not in the public domain in your country:
- Contact us via contact@quireandquill.com with the book title, author, and the country where you believe it is still under copyright.
- We will investigate within 14 business days.
- If we confirm your claim, we will either remove access for users in that country or remove the book entirely.
We are not liable for any penalties you may incur for downloading a book that is not in the public domain in your country. You use the Platform at your own risk.
6. Termination
We reserve the right to suspend or permanently terminate your account immediately, without notice, if you:
- Engage in hate speech or abusive reviews as defined in Section 3.
- Violate our intellectual property rules (Section 4).
- Attempt to scrape, hack, or damage our Platform.
- Violate any other material provision of these Terms.
In cases of less severe violations, we may issue a warning first. Upon termination, your right to use the Platform ends immediately.
7. Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT (INCLUDING BOOKS, TEXTS, IMAGES, AND OTHER MATERIALS) ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. QUIRE AND QUILL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR SUITABILITY OF ANY CONTENT.
SPECIFICALLY, YOU ACKNOWLEDGE AND AGREE THAT:
- The books and texts on Quire and Quill are not edited, corrected, or updated from their original author-written form. They are presented exactly as sourced from public domain archives. The text you see is the same as originally written by the author.
- We do not warrant that any text is free from errors, omissions, archaic language, or potentially offensive historical content.
- We do not warrant that any book is in the public domain in your country. You are solely responsible for verifying copyright status in your jurisdiction.
- We do not warrant that the Platform will be uninterrupted, secure, or error-free.
SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE ABOVE DISCLAIMERS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIRE AND QUILL AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages (including loss of data, loss of revenue, or personal injury) arising out of or related to your use of or inability to use the Platform.
- Any damages resulting from your reliance on any text, including but not limited to: offensive historical content, errors, omissions, or outdated language.
- Any copyright infringement claims, fines, or penalties imposed by your local government or any third party arising from your downloading or accessing of a book that is not in the public domain in your country.
- Any emotional distress, reputational harm, or other non-economic damages caused by unedited historical texts.
IN NO EVENT SHALL QUIRE AND QUILL'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) $100 USD, OR (B) THE AMOUNT YOU HAVE PAID US IN THE PAST 12 MONTHS. If you use the Platform for free, our total liability to you is $0.
9. Indemnification (Hold Harmless)
You agree to defend, indemnify, and hold harmless Quire and Quill and its owners, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your violation of these Terms.
- Your violation of any law or third-party rights (including copyright laws in your country).
- Your downloading or use of any book that is not in the public domain in your jurisdiction.
- Any content you post on the Platform.
10. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice on our website and/or sending an email to the address associated with your account (if you have one). Changes are effective 30 days after posting for existing users and immediately for new users. Your continued use after the effective date constitutes acceptance.
11. Third-Party Links
The Platform may contain links to third-party websites or services. We are not responsible for their content, privacy policies, or practices. You access them at your own risk.
12. Force Majeure
Quire and Quill shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of government, internet outages, or cyberattacks.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14. Entire Agreement
These Terms constitute the entire agreement between you and Quire and Quill regarding your use of the Platform and supersede all prior agreements.
